WhatsApp Business API in the US, built on the messages that arrive

Meta's own documentation says WhatsApp does not currently deliver marketing templates to people with US phone numbers. Order updates, passcodes and replies to customers still go through, and that is where a US programme starts.

For Indian businesses with American customers, and US companies weighing InfiQ: WhatsApp does not currently deliver marketing templates to US numbers, so this page shows how to build on utility, authentication and service messages, when to send, where the TCPA question stands, and what it costs.

First, what WhatsApp delivers to US numbers

Most country guides open with the economy. This one opens with a platform rule, because it decides what a US programme can send at all.

Meta's developer documentation states that WhatsApp does not currently deliver marketing template messages to WhatsApp users with United States phone numbers, meaning numbers with the +1 country code and a US area code.[1]

The statement covers marketing templates only. Utility templates (order, account and appointment updates), authentication templates (one-time passcodes) and service replies to customers who write first are not covered by it.[1]

Meta said in July 2024 that WhatsApp served more than 100 million monthly active users in the US, while describing the US as a market where WhatsApp was not yet the leading messaging app.[2]

About 94.7% of people in the US used the internet in 2024, according to World Bank data.[3]

The US is the world's largest economy, with nominal GDP of about US$30.9 trillion in 2025 by the IMF's estimate, and a population of about 341.8 million.[4],[5]

Spanish is by far the most common other home language: in 2019 it accounted for 62% of people who spoke a language other than English at home, the Census Bureau reports.[6]

Timing

Two coasts, and India's evening in between

Drag the send time to see when a message scheduled in India lands in New York. The shaded band is 8:00 to 21:00 at the recipient's end.

The contiguous states run from Eastern time (UTC-5) to Pacific (UTC-8), and most of them move an hour forward for daylight saving from March to November. An Indian team's working day falls in the American night: 09:00 to 18:00 IST is 23:30 to 08:30 in New York during daylight saving time.

So US sends from India are evening and overnight jobs. During daylight saving, 8:00 in New York is 17:30 IST and 8:00 in Los Angeles is 20:30 IST; a send that respects 8:00 to 21:00 on both coasts fits between 20:30 and 06:30 IST. From November to March, add an hour.

Why that band? The FCC's rule for telephone solicitations bars them before 8 a.m. or after 9 p.m. at the recipient's location. Whether it reaches WhatsApp is unsettled, so treat the band as a cautious house rule rather than a legal line. Messages a customer is waiting for, such as a passcode or a delivery update, go when they are needed.

InfiQ's broadcasts support segments and scheduling, so a national list can be split by time zone and each segment sent in its own daytime.

Compliance

The TCPA question nobody has answered yet

US messaging law was written for calls and texts to phone numbers. How much of it reaches an app-to-app WhatsApp message is still open, so build for the strict reading.

The US has no comprehensive federal privacy law. Marketing contact is governed mainly by the Telephone Consumer Protection Act (47 U.S.C. § 227) and the FCC's rules at 47 C.F.R. § 64.1200, alongside Section 5 of the FTC Act and state laws.[8],[12]

Regulator: Federal Trade Commission (privacy); the FCC writes the TCPA rules

  1. Point 1

No ruling yet on whether WhatsApp messages are TCPA 'calls'

The FCC applies its rules to text messages sent to wireless numbers, but we found no FCC rule or court decision deciding whether app-to-app messages such as WhatsApp count. After the Supreme Court's 2025 McLaughlin Chiropractic v. McKesson ruling that district courts are not bound by the FCC's interpretations, two district courts split in July 2025 on whether even SMS texts are 'calls' under § 227(c)(5).[8],[9]

  2. Point 2

The strict reading: prior express written consent

For advertising or telemarketing calls to wireless numbers made with an autodialer or an artificial or prerecorded voice, FCC rules require the called party's prior express written consent. If a court ever treats WhatsApp messages as calls, consent collected to that standard is the record you will want.[8]

  3. Point 3

Quiet hours and do-not-call, written for phones

FCC rules bar telephone solicitations before 8 a.m. or after 9 p.m. at the called party's location, and rules adopted in December 2023 codified that the National Do-Not-Call Registry's protections extend to text messages. Whether either reaches app messaging has not been decided.[8],[9]

  4. Point 4

The one-to-one consent rule is not in force

The FCC's 2023 rule limiting each consent to a single seller was vacated by the Eleventh Circuit on 24 January 2025, in Insurance Marketing Coalition v. FCC.[10]

  5. Point 5

    States add their own layer

A growing number of states have comprehensive consumer-privacy laws. California's, the CCPA as amended by the CPRA, is enforced by the California Privacy Protection Agency (CalPrivacy), created by Proposition 24 in November 2020. Plan for the strictest state on your list.[11]

  6. Point 6

The FTC watches what the message says

Section 5(a) of the FTC Act prohibits unfair or deceptive acts or practices in or affecting commerce, whichever channel carries them. The FTC describes itself as the chief federal agency on privacy policy and enforcement since the 1970s.[13],[12]

  7. Point 7

WhatsApp's policy already sets the floor

Whatever the statutes turn out to cover, Meta's WhatsApp Business Messaging Policy requires the person's phone number or username and their opt-in confirming they want messages from you before you send.[15]

English first, Spanish close behind

Meta approves each template per language, so a bilingual US programme means two versions of every utility template.

Spanish is the language most often spoken at home after English, as the Census figures above show, so a programme for a national consumer audience should plan for both. Store each contact's language preference and send the matching template.

Replies inside the 24-hour customer service window can be in whatever language your agents write. InfiQ's own support team works in English and Hindi.

On InfiQ

The InfiQ pieces a US programme uses

Utility-first messaging leans on approved templates, careful timing and a consent trail that would stand up if anyone asked.

  • Template manager and library

Draft, submit and track WhatsApp message templates for Meta's approval, starting from a library of 1,000+ ready templates in 27 categories.

Utility and authentication templates carry a US programme today; draft, submit and track them for Meta's approval in English and Spanish.

  • Broadcast campaigns

Send approved template campaigns to up to 2,00,000 contacts per broadcast, with segments, scheduling and delivery analytics.

For utility notices to many customers at once, such as a service change, segments and scheduling let one list go out coast by coast.

  • Consent records and opt-out enforcement

Each contact's opt-in source and time are recorded, STOP replies are enforced at platform level (even against later imports), and the audit trail exports.

With the TCPA question open, keep proof: the source and time of every opt-in, and STOP enforced even against contacts imported later.

  • Shared team inbox

One WhatsApp number answered by a team: 10 users on Lite and 25 on Growth, agent and manager roles, transfers, private notes, labels and canned replies.

Customers who write first are answered from one number by agents across shifts, with transfers, notes and labels.

  • Developer API and webhooks

A REST API with scoped keys, idempotency keys and per-key rate limits, plus HMAC-SHA256-signed webhooks retried for 24 hours. Included on Growth, an add-on on Lite.

Order, shipping and passcode events from your own systems trigger templates through the API; signed webhooks report status back.

  • Guided onboarding

InfiQ guides Meta business verification, number registration and display-name approval; with verification done, a number is typically live in about two hours.

Meta business verification is the slow step; once it is complete, a number is usually live in about two hours.

Two ways in

Two ways into the US

InfiQ is built for India-based businesses that message customers abroad. A company based in the US starts with a conversation with sales.

Your business is in India

  1. 1.

Sort your US messages by category

List what you send Americans today and sort it into utility, authentication, service and marketing. Anything in the marketing column needs another channel for US numbers for now.

  2. 2.

Collect opt-in that would stand up to scrutiny

Ask in writing, name WhatsApp and your business, and record when and where. InfiQ's consent records keep that trail.

  3. 3.

    Verify, then go live

Start with a 7-day Lite trial, no card needed. Once Meta business verification is complete, a number is typically live in about two hours.

  4. 4.

    Schedule by time zone

Segment the list by zone and send each segment inside its own daytime band, using the clock above.

Your business is in the US

  1. 1.

    Start with sales

InfiQ serves India-based businesses. For a company based in the US, availability goes through sales; tell us your volumes and use cases.

  2. 2.

    Check billing and data location

InfiQ invoices in Indian rupees and processes customer data in India. Weigh both against your own procurement and privacy requirements.

  3. 3.

    Size the programme

Share your monthly volumes by category; sales confirms rates and any volume discount on your account.

Questions businesses ask about WhatsApp in the US

  1. Q1

Can we send WhatsApp marketing templates to customers with US (+1) numbers right now?

No. Meta's documentation states that WhatsApp does not currently deliver marketing template messages to users with US phone numbers, which it applies to +1 numbers with a US area code. Utility, authentication and service messages are not covered by that statement, so a US programme today runs on order and account updates, passcodes and replies to customers who write first. Canadian +1 numbers are not affected; see the per-user marketing limit entry for how Meta caps marketing elsewhere.

  2. Q2

Does the TCPA apply to WhatsApp Business messages?

Nobody can say yet. The TCPA and the FCC's rules were written for calls and texts to phone numbers, and no FCC rule or court decision we found decides whether an app-to-app WhatsApp message counts. District courts split in July 2025 even on whether SMS texts are calls under one section of the Act. The prudent course is to collect consent that would meet the strict reading, send in daytime hours and honour opt-outs at once.

  3. Q3

What should a WhatsApp opt-in from a US customer record so it holds up later?

Who agreed, to what, where and when. A strong record names your business and WhatsApp, describes the messages the person will receive, keeps the wording they saw, and stores the time and source of the opt-in. InfiQ's consent records keep the source and time of every opt-in, enforce STOP replies at platform level and export as an audit trail.

  4. Q4

Can customers who already text with us by SMS be moved to WhatsApp?

Treat it as a fresh opt-in. Meta's policy asks for the person's opt-in confirming they want messages from you, and an SMS sign-up record may not show that for WhatsApp. One clean route is to text existing subscribers a click-to-chat link; when they write to you, they have started the conversation, and your reply can confirm their WhatsApp opt-in.

  5. Q5

How do we keep opt-outs consistent across WhatsApp, SMS and email?

Make one system the record of who has opted out. On WhatsApp, InfiQ enforces STOP replies at platform level, even against contacts imported later, and the audit trail exports. Use that export, or your own integration over InfiQ's API, to update the suppression lists in your SMS and email tools.

  6. Q6

What do utility and passcode messages to US numbers cost on InfiQ?

A delivered utility message to a US number costs ₹0.2989, an authentication message ₹0.2989 and a service reply ₹0.2989, at Meta's North America rate and excluding GST. Plans start at ₹999 a month for Lite and ₹2,999 for Growth. InfiQ invoices in rupees, and volume commitments earn discounts confirmed on your account.

  7. Q7

Can one WhatsApp number serve customers on both coasts?

Yes. One number and one shared inbox can serve the whole country; what changes is timing. Split broadcast lists by time zone and schedule each segment for its own daytime, and staff the inbox for the hours your customers write, which from India means evening and night shifts.

  8. Q8

We are a company based in the US. Can we sign up with InfiQ?

Talk to sales first. InfiQ serves India-based businesses: it bills in rupees, processes customer data in India and supports customers in English and Hindi on India time. Sales can tell you whether and how InfiQ is available to a business based in the US before you plan around it.
