WhatsApp Business API for Spain, priced message by message

Almost every internet user in Spain is on WhatsApp, and Spanish law wants express authorisation before a promotion lands there. Price your month first, then build the consent that lets you send it.

Market brief

Spain, in six lines

A growing economy, a record year for tourism and a messaging habit that leaves little room for other apps.

  1. 01

Spain's GDP grew 2.6% in volume in 2025, according to INE's annual estimate of 18 September 2026, revised down from its earlier figure; 2024 growth was revised up to 3.7%.[6]

  2. 02

Nominal GDP reached €1,690,012 million in 2025, of which services generated about €1,158,092 million of gross value added.[6]

  3. 03

Spain received 96.8 million international tourists in 2025, an all-time high and 3.2% more than in 2024 (provisional).[7]

  4. 04

In the CNMC's household panel (Q4 2025 wave, published May 2026), 94.6% of internet users said they use WhatsApp habitually; Instagram (27.6%) and Telegram (17.4%) trail far behind as messaging apps.[1]

  5. 05

Comunidad de Madrid is the largest regional economy, with GDP of €337,216 million in 2025, ahead of Catalonia at €319,985 million; Madrid's GDP per capita of €47,220 compares with a national €34,237 (INE advance estimates).[8]

  6. 06

Bizum, the mobile payment service built into Spanish banks' apps, cites 31.5 million active users on its website (undated).[9]

The same mix sent to numbers in India would cost ₹3,557. Meta prices each message by the recipient’s country, so what you pay depends on where your customers are, not where your business is.

InfiQ’s per-message rates for this market, effective 1 October 2026, in ₹ excluding GST. Volume commitments earn discounts; the final rate is confirmed on your account.

In Spain a marketing message costs far more than a utility one, so keeping order, booking and delivery news in utility templates, and offers for the people who authorised them, is the biggest lever on the bill.

Compliance

LSSI article 21: express authorisation first

Spain regulates promotional messages through its information-society law, and the data-protection agency has already applied it to WhatsApp.

Ley 34/2002 (LSSI), article 21.1, prohibits advertising or promotional communications by email or an equivalent electronic medium unless the recipient asked for them or expressly authorised them beforehand.[4]

Regulator: Agencia Española de Protección de Datos (AEPD)

  1. Point 1

    Already applied to WhatsApp

Economist & Jurist reported in October 2024 that the AEPD fined an energy consultancy €5,000 under article 21.1 for WhatsApp advertising the recipient had neither requested nor authorised. The resolution itself was not reviewed for this page.[10]

  2. Point 2

    The existing-customer exception is narrow

Article 21.2 allows messages without fresh authorisation only where there is a prior contract, the contact data was obtained lawfully, the messages concern the sender's own similar products or services, and a simple, free way to object is offered at collection and in every message. It is not a general pass for B2B lists or past customers.[4]

  3. Point 3

    Exclusion lists before direct marketing

LOPDGDD article 23.4 requires anyone planning direct-marketing communications to consult the advertising-exclusion systems that may affect them first, such as Lista Robinson, unless the person gave that company express consent.[11]

  4. Point 4

Lista Robinson does not list WhatsApp

Lista Robinson, run by the digital-economy association Adigital, covers advertising by phone, post, email and SMS/MMS. Its page does not mention WhatsApp or instant messaging.[12]

  5. Point 5

Offers must say who and how much

The consolidated consumer law (TRLGDCU, article 20) sets the information a commercial offer must carry, such as the trader's identity, the essential features and the full final price.[13]

  6. Point 6

    Meta's opt-in on top

WhatsApp's Business Messaging Policy separately requires the person's opt-in to messages from your business before you contact them.[14]

  7. A summary of public guidance from the sources cited, not legal advice.

Ley 10/2025 and the WhatsApp help desk

Spain's customer-service law came into force on 28 December 2025 with twelve months to adapt. It does not cover every company, but where it applies it shapes how a WhatsApp help desk has to work.

It applies to providers of essential services and to large companies: 250 or more employees, turnover above €50 million or a balance sheet above €43 million.[5]

Automated systems and chatbots must offer a route to a human at any point, and 95% of requests for personal attention must be handled in under three minutes on average.[5]

Complaints must be resolved within 15 working days unless sector rules differ, and the answer must be in the language the complaint was filed in (article 13.6).[5]

Companies may use instant messaging to answer questions during contracting; calls, video calls and instant messages may be recorded with express consent, with copies kept until the matter is resolved.[5]

Customer-service phone lines must use a numeric code distinct from the one for commercial calls (article 16.3), a rule written for phone lines rather than messaging.[5]

Madrid time, and the Canaries an hour behind

Mainland Spain keeps Central European Time; the Canary Islands run one hour behind on Western European Time.

Seen from India, Madrid is three and a half hours behind in summer and four and a half in winter, once the clocks go back on 25 October 2026; the Canaries are one hour further back. A broadcast queued for 10:00 in Madrid reaches Las Palmas at 9:00, so schedule by island if Canary customers matter to you.

Madrid and Catalonia are the two largest regional economies. Turn the globe to see Spain beside Portugal and the rest of Western Europe.
