Messaging Poland on WhatsApp under the 2024 Electronic Communications Law

Poland has its own line on Meta's rate card and a consent rule with no exception for existing customers or company inboxes. Price the messages first, then read the rule.

For Indian businesses selling to or supporting customers in Poland, and for Polish firms evaluating InfiQ: what a month of +48 messages costs, what Article 398 of the 2024 Electronic Communications Law requires, and why company contacts need consent too.

What it costs

Price a month of messages to Polish numbers

Poland is priced as its own Meta market, not at a regional rate. Move the sliders to see what a month to +48 numbers would cost on InfiQ, beside the same mix sent within India.

The same mix sent to numbers in India would cost ₹25,938. Meta prices each message by the recipient’s country, so what you pay depends on where your customers are, not where your business is.

InfiQ’s per-message rates for this market, effective 1 October 2026, in ₹ excluding GST. Volume commitments earn discounts; the final rate is confirmed on your account.

The starting volumes are illustrative, not a forecast. Every marketing message in the mix assumes the recipient gave consent that names WhatsApp, as the rules below explain.

Compliance

Article 398: the rule that decides who you may message

Poland's 2024 Electronic Communications Law (Prawo komunikacji elektronicznej, PKE) is where the consent rule now lives. Read it precisely: what it covers, who it protects, and what it leaves out.

Article 398(1) of the PKE of 12 July 2024 bans using automated calling systems or telecommunications terminal equipment, 'in particular' via interpersonal communications services, to send commercial information, including direct marketing, to a subscriber or end user unless they gave prior consent.[1]

Regulator: UODO (personal data); the UKE and UOKiK presidents also act on unsolicited marketing

  1. Point 1

Interpersonal communications services are named in the text

The PKE defines interpersonal communications services to include number-independent services. WhatsApp itself is not named, so applying Article 398 to it is an interpretation; the safe course is to treat WhatsApp marketing to Polish numbers as covered.[1]

  2. Point 2

Companies are protected, not only consumers

Protection covers all natural persons, including sole traders, and organisational units such as companies, foundations and universities. A WhatsApp offer to a buyer at a Polish company needs consent just as a consumer offer does.[1],[3]

  3. Point 3

    No existing-customer exception

Article 398 has no 'soft opt-in'. Having sold to someone before does not let you send them commercial information without their prior consent.[1]

  4. Point 4

    Consent is given per channel

Article 400 says consent is obtained under data-protection (GDPR) rules. The Ministry of Digital Affairs says it must be voluntary, informed, unambiguous and specific, and that 'specific' means a named communication channel, so e-mail or SMS consent does not stretch to WhatsApp.[1],[3]

  5. Point 5

    No register to screen against

Poland chose an opt-in model and has no national do-not-call or objection register. Answering a Sejm interpellation on 30 September 2025, the Ministry said it does not plan one and that the opt-in rule puts the burden of proof on businesses.[3]

  6. Point 6

Asking for consent mid-contact is not allowed

The Ministry adds that asking for consent to present an offer during a phone call is not permitted, as decisions of the UKE and UOKiK presidents have confirmed. Collect consent before the channel is used, not through it.[3]

  7. Point 7

    What a breach costs

The UKE President can fine a breach of the consent obligation up to 3% of the previous year's revenue or PLN 1,000,000, whichever is higher (Article 446(5)). Sending commercial information without consent is also an act of unfair competition (Article 398(4)), and Article 448 provides a petty-offence fine.[1]

  8. Point 8

Older guidance is out of date; check the current text

The PKE took effect on 10 November 2024 and unified rules previously split between the Telecommunications Law and the Act on Providing Services by Electronic Means. The Sejm's record lists several amending acts since, so the article references here, taken from the 2024 text, should be checked against the consolidated version.[2],[1]

  9. Point 9

    WhatsApp's own policy agrees

Meta's WhatsApp Business Messaging Policy separately requires a person's opt-in before a business messages them on WhatsApp.[4]

  10. A summary of public guidance from the sources cited, not legal advice.

Where the +48 numbers are

Poland runs on Central European time, a few hours behind India, which keeps most of a Polish working day inside an Indian one.

Drag the globe from India west to Poland. A broadcast scheduled for nine in the morning in Warsaw goes out around lunchtime in India, so an Indian team can send to Polish customers and answer their replies within its own working day.

Poland moves its clocks with EU summer time and India does not, so the gap changes twice a year. Schedule campaigns in Polish local time rather than IST and the change takes care of itself.

Market brief

The market behind the numbers

A large EU economy with a strong industrial base and a growing share of people on messaging apps, in sourced lines.

  1. 01

The IMF estimates Poland's 2025 GDP at about US$1.04 trillion, up from about US$0.92 trillion in 2024, and GDP per head at about US$28,500. The 2025 values are estimates.[5]

  2. 02

The European Commission calls Poland's economy one of the fastest growing in the EU, with GDP up 2.9% in 2024.[6]

  3. 03

Industry, excluding construction, generated 22.9% of Poland's gross value added in 2024, against 19.4% for the EU.[7]

  4. 04

    Poland's population was 36,332,765 on 1 January 2026, down from 36,497,495 a year earlier.[8]

  5. 05

Eurostat counts 74.93% of people in Poland using instant messaging in 2025, up from 70.97% in 2024; the EU figure was 82.31%. The survey covers all messaging apps, not WhatsApp alone.[9]

  6. 06

PAIH, the government's investment agency, names Warsaw, Kraków and Wrocław as Poland's most globally recognised ICT hubs, and puts Kraków alone at about 60,000 IT professionals, citing a 2024 market report.[10]

  7. 07

PAIH also cites Poland's 13th place out of 113 countries on the EF English Proficiency Index, which makes English workable for B2B and IT audiences; consumer messages belong in Polish, the official language.[10],[14]

  8. 08

BLIK, run by Polski Standard Płatności, lets people pay online and in shops with one-off six-digit codes valid for two minutes, and send money to a phone number.[15]

Who messages what

Industries that message, and what they send

Every use case below assumes consent collected first: under Article 398 that applies to business buyers as much as to shoppers.

SectorWhat it sends on WhatsApp
ICT and softwareICT exports were US$16.85 billion in 2023, up from US$13.48 billion in 2022, and PAIH puts the developer pool at about 600,000 programmers.[10]
  • Support in a shared team inbox
  • API-triggered product notifications
  • Login codes
Agri-foodAgri-food exports were worth over €53.5 billion in 2024; Poland is the EU's largest apple producer and has led EU poultry-meat production since 2014, PAIH says.[11]
  • Order intake from retail and HoReCa buyers
  • Delivery confirmations
  • Price-list updates to opted-in buyers
Automotive and e-mobilityAbout 197,000 people worked in the sector in 2024, and Poland was the world's seventh-largest exporter of automotive components in 2023, according to PAIH.[12]
  • Service-appointment booking
  • Parts availability
  • B2B order status
Manufacturing regionsThe strongest manufacturing base is in western and southern Poland, in Dolnośląskie, Śląskie and Wielkopolskie, where an automotive legacy meets growing clean-tech manufacturing.[6]
  • Shift and logistics notices

  • Delivery tracking
  • Promotions to contacts with WhatsApp consent
Pharmaceuticals and medical devicesPAIH lists pharmaceuticals and medical devices among its seven priority sectors, alongside aerospace, machines, electronics, automotive, food and ICT.[13]

On InfiQ

Built for an opt-in-only market

In Poland the consent record comes before everything else, so it sits at the top of this stack.

  1. Consent records and opt-out enforcement

Article 398 puts the proof on you. InfiQ keeps the source and time of each WhatsApp opt-in, separate from any e-mail or SMS consent you hold elsewhere, and STOP replies are enforced at platform level.

  2. Broadcast campaigns

Campaigns go only to the segment that gave WhatsApp consent, with business contacts held to the same rule as consumers.

  3. Template manager and library

Polish versions of order, delivery and payment-reminder templates, submitted and tracked through Meta's approval.

  4. Developer API and webhooks

Polish software houses and Indian shops alike can trigger messages from their own systems, with signed webhooks back to them.

  5. Shared team inbox

Support teams answering Polish customers share one number, with transfers, private notes and labels.

  6. Guided onboarding

Meta business verification first; once it is complete, a number is typically live in about two hours.

Getting started

From first opt-in to first Polish template

The order matters in Poland: consent before contact, for every contact.

  1. From India

    Add a WhatsApp-specific opt-in

A separate checkbox that names WhatsApp, on your checkout, account or B2B order form. Do not reuse e-mail consent.

  2. From India

    Verify your business with Meta

Once verification is complete, InfiQ typically has your number live in about two hours.

  3. From India

    Write the Polish templates

Order, delivery and payment-reminder templates in Polish, submitted through the template manager.

  4. From India

Send to the consented segment only

Utility updates to customers who opted in to WhatsApp; campaigns only where your record shows WhatsApp marketing consent.

  5. Based in Poland

    Read what InfiQ is

An India-based Meta Business Partner that bills in rupees, keeps customer data in India and supports customers in English and Hindi on India time.

  6. Based in Poland

    Talk to sales

Availability for businesses based outside India goes through sales; we will say plainly whether InfiQ fits your case.
