WhatsApp Business API in Brazil, from Olá to Pix

In Brazil, WhatsApp is the usual way to reach a business and Pix the usual way to pay one. Two rules around messaging customers changed in 2026; here is what they mean for your messages.

For Indian businesses selling to Brazil, and Brazilian companies considering InfiQ: how the LGPD and the renamed ANPD treat WhatsApp marketing, which suppliers the 2026 SAC decree reaches, how a Pix payment link fits a WhatsApp order, and what messages cost.

A WhatsApp country with an instant-payment habit

Brazilian customers already message businesses and pay by Pix from the same phone. The figures behind that.

The U.S. International Trade Administration describes WhatsApp as the most common mode of communication via mobile phone in Brazil, preferred over e-mail or phone calls even for business.[1]

Cetic.br's TIC Domicílios 2025 survey found that 92% of Brazilian internet users had sent instant messages; the survey does not split the figure by app.[2]

Pix, the Banco Central do Brasil's instant-payment system launched on 16 November 2020, was used by more than 150 million individuals for 7.8 billion transactions in September 2026; Pix Automático for recurring payments was added in 2025.[3]

The U.S. ITA says Pix is the most used payment method in Brazil, more so than cash.[4]

Brazil is Latin America's largest economy, with nominal GDP of about US$2.28 trillion in 2025 by the IMF's estimate, and about 212.8 million people.[6],[7]

The city of São Paulo alone produced R$1.07 trillion of GDP in 2023, about 9.7% of Brazil's R$10.94 trillion total, according to IBGE.[8]

Portuguese is Brazil's official language under Article 13 of the Federal Constitution.[9]

An order paid by Pix, step by step

InfiQ does not take payments. It carries the messages around one: the link to pay, the confirmation, and the questions in between.

The payment itself happens outside WhatsApp, in the customer's bank app, through the payment provider your store already uses. InfiQ's part is the messaging: your system passes the order details and the provider's payment link to InfiQ's API, and a pre-approved utility template delivers them.

When the provider tells your system that the Pix has settled, a second template confirms it. If the customer replies with a question, the conversation lands in the shared inbox and your agents answer inside the 24-hour window.

For subscriptions, Pix Automático is set up through your payment provider; WhatsApp carries the reminders and the receipts.

Compliance

LGPD, the new ANPD, and the SAC decree

Brazil's data-protection law sets the basis for messaging people. A 2026 decree sets service standards for some regulated suppliers, and names instant messaging as a channel.

The Lei Geral de Proteção de Dados (LGPD, Law 13,709 of 2018), most recently amended by Law 15,352 of 25 February 2026, governs personal data in Brazil. It has no rule written specifically for marketing messages and does not mention messaging apps.[10],[11]

Regulator: Agência Nacional de Proteção de Dados (ANPD)

  1. Point 1

Pick a legal basis: consent or legitimate interest

Processing is lawful only on one of the bases in Article 7, which include the data subject's consent and the controller's or a third party's legitimate interests. The LGPD does not say marketing always needs consent, nor that consent is never needed. Whichever basis you use, WhatsApp's own policy still requires an opt-in to messages from you.[10],[21]

  2. Point 2

If consent is your basis, you must be able to prove it

Consent must be given in writing or by another means that shows the person's will; the controller bears the burden of proof, and consent can be revoked at any time through a free and simple procedure (Article 8).[10]

  3. Point 3

Fines up to 2% of Brazilian revenue

Penalties can reach 2% of a company's revenue in Brazil, capped at R$50 million per infraction (Article 52).[10]

  4. Point 4

The ANPD is now an agency

Law 15,352 of 25 February 2026 turned the Autoridade into the Agência Nacional de Proteção de Dados, a special-regime autarchy linked to the Ministry of Justice with functional, technical, decision-making, administrative and financial autonomy. The acronym is unchanged.[11]

  5. Point 5

    Decree 13,135: who it covers

The new customer-service (SAC) decree of 9 October 2026 was published on 13 October and takes effect 20 days later, replacing Decree 11,034/2022. It applies to federally regulated suppliers that meet their regulator's criteria and to digital financial services supervised by the Central Bank, not to every business.[12]

  6. Point 6

Decree 13,135: what it asks of a WhatsApp channel

Its electronic channels expressly include instant-messaging services. At least one channel must work around the clock; real-time human service must be available from 8:00 to 20:00 every day; automation and AI are allowed only if a human option is assured; advertising is banned in SAC channels; and message content must be kept for at least 90 days.[12]

  7. Point 7

    Advertising must look like advertising

The Consumer Defence Code requires advertising to be identifiable as such (Article 36), prohibits misleading or abusive advertising (Article 37) and treats supplying a product or service without prior request as an abusive practice (Article 39, III).[13]

  8. Point 8

Não Me Perturbe is about calls

Brazil's self-regulatory do-not-call list stops telemarketing calls from participating telecom operators and financial institutions. It covers calls, not WhatsApp messages.[14]

  9. A summary of public guidance from the sources cited, not legal advice.

Four time zones, one that does most of the work

São Paulo, Rio de Janeiro and Brasília all keep Brasília time, three hours behind UTC, and Brazil has not used daylight saving since 2019.

Brazil spans four time zones, from UTC-2 on oceanic islands such as Fernando de Noronha to UTC-5 in the far west. Customers in the western states sit one or two hours behind São Paulo, so a send timed for the Southeast arrives early there.

From India, São Paulo is eight and a half hours behind: 18:30 IST is 10:00 in São Paulo, and the Indian working day ends as Brazil's begins.

On InfiQ

The InfiQ pieces Brazil asks for

Payment-link messaging, Portuguese templates and a human option behind every bot.

  • Developer API and webhooks

A REST API with scoped keys, idempotency keys and per-key rate limits, plus HMAC-SHA256-signed webhooks retried for 24 hours. Included on Growth, an add-on on Lite.

Your store or payment provider hands order details and Pix links to InfiQ's API; signed webhooks report message status back.

  • Template manager and library

Draft, submit and track WhatsApp message templates for Meta's approval, starting from a library of 1,000+ ready templates in 27 categories.

Payment-link and confirmation templates in pt_BR, drafted and tracked through Meta's approval.

  • Shared team inbox

One WhatsApp number answered by a team: 10 users on Lite and 25 on Growth, agent and manager roles, transfers, private notes, labels and canned replies.

Where the SAC decree applies it expects a human option; the shared inbox lets a team of agents take over conversations, with transfers and notes.

  • InfiQ Flows chatbot builder

A no-code builder for automated conversations (27 blocks, versioned publishing with rollback), priced per flow; the Growth plan includes one.

Automate the first answers in Portuguese with a no-code flow, and let agents pick up in the inbox when a customer needs a person.

  • Consent records and opt-out enforcement

Each contact's opt-in source and time are recorded, STOP replies are enforced at platform level (even against later imports), and the audit trail exports.

If consent is your legal basis, Article 8 puts the proof on you; InfiQ records the source and time of every opt-in.

  • Customer data hosted in India

InfiQ processes customer data in data centres located in India; website telemetry vendors are listed separately in the subprocessor list.

Customer data is processed in data centres in India; include that in your LGPD records of where data goes.
