WhatsApp for customers in Türkiye: three layers of rules, one message

Türkiye has been open to WhatsApp Business Platform messaging since Meta lifted its restriction in May 2024. A campaign message still has to pass three layers of rules, and one question inside them is open.

For Indian exporters, travel firms and brands with customers in Türkiye, and Turkish businesses weighing InfiQ: how WhatsApp's policy, the commercial-messages law and KVKK each apply, why İYS is an open question for counsel, what a +90 message costs, and how to start.

See it work

Three layers a campaign message passes through

A WhatsApp campaign to a Turkish number has to clear WhatsApp's own policy, the commercial-messages law and the data-protection law. Step down through them.

Order, delivery and payment-reminder notifications sit outside the Regulation's prior-consent requirement as long as they promote nothing, but they still need WhatsApp's opt-in and a lawful basis under KVKK.

The İYS layer is marked in amber on purpose. We found no Ministry text naming WhatsApp, so treat it as a question for your counsel rather than a settled rule, and settle it before your first campaign rather than after.

One campaign message, three layers of rules

PayloadA campaign message to a +90 number

Enters at the top, travels down through 5 layers

A simplified reading of the sources cited in the next section, not legal advice. Whether İYS registration applies to WhatsApp is not settled in any official text we found, so that layer is marked as an open question.

Hop 5 of 5: the payload is in layer 5, Delivered. Only a message that clears every layer should reach the customer.

Compliance

The rules behind each layer

Türkiye's commercial-messages rules are detailed, and their fines are revalued every year. Some of these texts changed in 2026, so the last point says what to check.

Article 6(1) of Law No. 6563 on the Regulation of Electronic Commerce allows commercial electronic messages to be sent only if the recipient's prior consent has been obtained, in writing or by any electronic means.[3]

Regulator: Ministry of Trade (Ticaret Bakanlığı), through İYS

  1. Point 1

Notifications that promote nothing need no prior consent

Law 6563 exempts messages about changes, use or maintenance of goods or services already supplied, and the Regulation lists notifications about an ongoing subscription, collection, debt reminders, data updates, purchase and delivery. None of them may promote goods or services (Regulation Art. 6(2)).[3],[4]

  2. Point 2

Consent cannot be requested by commercial message

Article 7(4) of the Regulation bars asking for consent by sending a commercial message. Collect it on a web form, at checkout or in a signed order.[4]

  3. Point 3

İYS: what it requires, and the open question

The Regulation requires senders to register in İYS (Art. 5(2)) and to message only recipients whose consent is recorded there (Art. 5(3)); consents collected outside İYS must be uploaded within three business days or they are invalid (Art. 7(11) and (12)). Its definition lists telephone, call centres, fax, automatic dialling, e-mail and SMS 'gibi vasıtalar' (such means) and does not name WhatsApp, and the Ministry's İYS announcement describes SMS, calls and e-mail. Whether these duties apply to WhatsApp is an open question for counsel.[4],[5]

  4. Point 4

    Merchants and tradesmen

Law 6563 Art. 6(2) lets messages go to merchants and tradesmen (esnaf ve tacir) without prior consent, but the Regulation requires their addresses to be registered in İYS and checked for opt-outs first (Art. 6(3) and 6(6)). How that reaches WhatsApp is the same open question.[3],[4]

  5. Point 5

Identify the sender; make stopping easy

Commercial electronic messages must carry the sender's identifying details, for merchants the MERSİS number and trade name (Regulation Art. 8), and opting out must be free and easy through the same channel the message used (Art. 9(3)).[4]

  6. Point 6

    The fines for 2026

Breaching Law 6563 Art. 6(1) carries an administrative fine of TRY 2,859 to 14,309 for 2026, revalued every year, and the fine can be increased up to tenfold when messages go to more than one person at once (Art. 12(2)).[3]

  7. Point 7

KVKK: a lawful ground for the data

KVKK Art. 5(1) bars processing personal data without explicit consent ('açık rıza') unless another ground in Art. 5(2) applies, such as a contract, a legal obligation or legitimate interest.[6]

  8. Point 8

    KVKK: data going abroad

Law No. 7499 rewrote the cross-border rules in Art. 9 with effect from 1 June 2024: a transfer abroad needs an adequacy decision, appropriate safeguards or a narrow incidental exception. KVKK states that the Board has issued no adequacy decision yet; it adopted standard contracts on 4 June 2024, and a signed standard contract must be notified to the Authority within five business days (Art. 9(5)).[6],[7]

  9. Point 9

    Check the current texts

Law No. 6502 on consumer protection, which sets the Advertising Board's powers over advertising in Art. 63, was amended by Law No. 7587 of 24 June 2026, and Law 6563's fines change every year. Check the current consolidated texts before relying on any article.[8],[3]

  10. Point 10

    WhatsApp's own opt-in rule

Meta's WhatsApp Business Messaging Policy requires a person's opt-in before a business messages them, whatever Turkish law says about the message.[2]

  11. A summary of public guidance from the sources cited, not legal advice.

Türkiye in sourced lines

A large, young market that Meta's platform has served fully only since 2024.

Meta's WhatsApp Business Platform support page says that, as of 15 May 2024, Türkiye is no longer restricted for Cloud API business messaging.[1]

The IMF estimates Türkiye's 2025 GDP at about US$1.60 trillion and GDP per head at about US$18,680. Both are estimates.[9]

Invest in Türkiye, the government's investment office, reports average annual growth of 5.3% over 2003 to 2024 and says half the population is under 34.9 years old.[10]

The population was 85,664,944 on 1 January 2025, and industry, excluding construction, generated 22.3% of gross value added in 2024.[11],[12]

Eurostat counts 86.79% of people in Türkiye using instant messaging in 2025, up from 83.40% in 2024, against 82.31% across the EU. The survey covers all messaging apps, not WhatsApp alone.[13]

Turkish is the language of the State and Ankara the capital, under Article 3 of the Constitution.[14]

FAST, the Instant and Continuous Transfer of Funds system, is among the payment systems the Central Bank of the Republic of Türkiye operates.[15]

Istanbul and Ankara, on one clock

Türkiye keeps the same clock all year, so the gap to India never moves.

Turn the globe from India towards the Bosphorus. Istanbul is the commercial and financial centre and Ankara the capital; both run on Türkiye's single, year-round time zone.

For an Indian team it is the simplest European-facing clock to plan around: a mid-morning send in Istanbul lands around lunchtime in India in January and July alike, with no spring or autumn shift to remember.

Agri-food

On InfiQ

What InfiQ covers, and what stays with you

Consent evidence at the top, because every layer above asks for it in some form.

  1. Consent records and opt-out enforcement

Each opt-in's source and time are recorded and exportable, the evidence you need whatever your counsel decides about İYS. InfiQ does not offer an İYS integration today.

  2. Template manager and library

Turkish versions of order, delivery and reminder templates, with your trade name and MERSİS number in the footer where the Regulation calls for them.

  3. Developer API and webhooks

The REST API and signed webhooks connect InfiQ to your own systems, including whatever process you use for İYS.

  4. Shared team inbox

Turkish- and English-speaking agents answer from one number, with transfers, labels and private notes.

  5. Broadcast campaigns

Campaigns only to contacts whose consent you hold on record, scheduled in Turkish time.

  6. Guided onboarding

Meta business verification first; once it is complete, a number is typically live in about two hours.

Two ways in

Two ways in

InfiQ serves India-based businesses directly; a business based in Türkiye starts with sales.

Your business is in India

  1. 1.

    Settle the İYS question first

Ask your counsel whether İYS applies to your WhatsApp messages to Turkish customers, and plan the consent flow around the answer.

  2. 2.

    Collect consent off WhatsApp

A consent box on your website, checkout or order form, recorded with its wording. Never ask for it in a commercial message.

  3. 3.

Verify with Meta and go live

Once Meta business verification is complete, InfiQ typically has your number live in about two hours.

  4. 4.

    Start with notifications

Turkish order, delivery and reminder templates that promote nothing, submitted through the template manager; campaigns once consent is in place.

Your business is in Türkiye

  1. 1.

    Know what InfiQ is

An India-based Meta Business Partner that bills in rupees, processes customer data in India and supports customers in English and Hindi on India time.

  2. 2.

    Raise KVKK Article 9 early

Customer data would be processed in India, which is a transfer abroad under KVKK. Put that to your counsel before anything is signed.

  3. 3.

    Talk to sales

Availability for businesses based outside India goes through sales, who will tell you plainly whether InfiQ fits.

Questions businesses ask about WhatsApp in Türkiye

Can businesses in Türkiye use the WhatsApp Business Platform now?
Yes. Meta's support page says that as of 15 May 2024 Türkiye is no longer restricted for Cloud API business messaging. InfiQ itself serves India-based businesses, so a business based in Türkiye should talk to sales about availability.
Do WhatsApp marketing consents have to be registered in İYS?
That is an open question to settle with counsel, not a rule we can state. The Regulation requires senders of commercial electronic messages to register in İYS and to message only recipients recorded there, but its channel list does not name WhatsApp, and we found no Ministry text that does. If counsel concludes it applies, consents collected outside İYS must be uploaded within three business days.
Which WhatsApp messages to Turkish customers need no prior consent?
Notifications that promote nothing: about an ongoing subscription, collection, debt reminders, data updates, a purchase or a delivery, under Article 6(2) of the Regulation. Add an offer and the message needs consent. WhatsApp's own policy still requires opt-in for any business message.
Can we ask Turkish customers for consent in a WhatsApp message?
Not by sending a commercial message: Article 7(4) of the Regulation bars requesting consent that way. Collect consent on your website, at checkout or in a signed order, and keep the record with its wording.
Do messages to Turkish merchants and tradesmen need consent?
Not prior consent under Law 6563 Art. 6(2), but that is not a free pass. The Regulation requires merchants' addresses to be registered in İYS and checked for opt-outs first, and whether that reaches WhatsApp is the same open question as for consumers.
What are the fines for unsolicited commercial messages in Türkiye in 2026?
TRY 2,859 to 14,309 per breach of Law 6563 Art. 6(1) for 2026, and up to ten times that when a message goes to more than one person at once. The amounts are revalued every year, so check the current table before relying on them.
What does a WhatsApp message to a Turkish number cost on InfiQ?
₹0.9587 per marketing message, ₹0.0792 per utility message, ₹0.0792 per authentication message and ₹0.0792 per service reply, ex-GST, against ₹0.94 for a marketing message to an Indian number. Plans start at ₹999 a month.
Does InfiQ connect to İYS?
No. InfiQ does not offer an İYS integration today. It records each opt-in's source and time and enforces STOP replies on WhatsApp; registering consents in İYS, if your counsel says you must, stays with you or the integrator you work with.
What does KVKK require if our customers' data leaves Türkiye?
Under Article 9 as rewritten in 2024, a transfer abroad needs an adequacy decision, appropriate safeguards or a narrow exception, and KVKK says no adequacy decision has been issued yet. A signed standard contract must be notified within five business days. InfiQ processes customer data in India, so a Turkish business should raise this with counsel and sales first.
