WhatsApp messaging to New Zealand, where the working day starts before India's

Three steps from the Department of Internal Affairs decide whether a WhatsApp promotion to a New Zealander is lawful: consent, identify, unsubscribe. Then comes the clock, because New Zealand starts work while India sleeps.

For Indian businesses with customers in New Zealand, and NZ firms considering InfiQ: New Zealand's spam law covers instant messaging, so WhatsApp marketing needs consent, a named sender and a free unsubscribe honoured within five working days. Here are those steps, the privacy rules, the time gap and the cost.

See it work

Consent, identify, unsubscribe: one WhatsApp opt-in, start to finish

The Department of Internal Affairs explains the Unsolicited Electronic Messages Act in three steps and says the Act covers instant messaging. Step through how they play out for one customer and one WhatsApp promotion.

DIA's three steps are the test most campaigns have to pass: have consent, identify yourself, and let people leave. Express consent, a clear yes to WhatsApp messages from your business, is the basis DIA recommends where there is no existing relationship.

Deemed consent covers business addresses that are conspicuously published, unless the publication says unsolicited messages are not wanted. For a list of consumers, rely on a recorded opt-in; InfiQ's consent records keep the source and time of each one.

Step 6 of 6: Your business (internal) — Removes the contact from every other channel. Unsubscribe requests must be honoured within five working days.

Compliance

The Privacy Act 2020, and the spam law's teeth

Two agencies, two laws. The Department of Internal Affairs enforces the spam law; the Privacy Commissioner oversees the Privacy Act. Both reach a WhatsApp programme.

The Privacy Act 2020 came into force on 1 December 2020, replacing the Privacy Act 1993; its 13 information privacy principles govern how agencies collect, store, use and share personal information.[10]

Regulator: Office of the Privacy Commissioner (Te Mana Mātāpono Matatapu)

  1. Point 1

The spam law names instant messaging

DIA says the Unsolicited Electronic Messages Act covers email, fax, instant messaging, text and image-based messages of a commercial nature with a New Zealand link. It does not cover internet pop-ups or voice telemarketing.[13]

  2. Point 2

    Express, inferred or deemed consent

Consent may take any of the three forms. DIA says inferred consent cannot reasonably be drawn from a single transaction, and recommends express consent where there is no existing relationship.[15]

  3. Point 3

Every message names its sender and offers a way out

Each commercial message must clearly identify the business responsible and how to contact it, and contain a functioning, free unsubscribe facility, with requests honoured within five working days.[13],[14]

  4. Point 4

    Fines of up to NZ$500,000

DIA enforces the Act with anything from formal warnings to High Court action for pecuniary penalties, and says non-compliance could mean a fine of up to NZ$500,000.[16]

  5. Point 5

Principle 12: personal information leaving New Zealand

Principle 12 covers disclosure of personal information outside New Zealand. InfiQ processes customer data in India; how Principle 12 applies to your use of it is a question for your privacy adviser.[10]

  6. Point 6

IPP 3A: data collected from someone else

Since 1 May 2026, when personal information is collected from someone other than the individual, the agency must take reasonable steps to tell the person about the collection, its purpose, the recipients and their rights. That matters if you enrich a contact list from another source.[11]

  7. Point 7

    Serious breaches are notified

If a privacy breach has caused or is likely to cause anyone serious harm, the agency must notify the Privacy Commissioner and the affected people as soon as practicable.[12]

  8. Point 8

    Promotions must not mislead

The Fair Trading Act makes it illegal for anyone in trade to mislead consumers, including about price, quality or discounts, and through impressions created by leaving important information out.[18]

  9. Point 9

Meta's opt-in rule sits on top

Whatever the statute allows, WhatsApp's Business Messaging Policy requires opt-in permission confirming the person wishes to receive messages from you.[19]

Market brief

New Zealand in five lines

A small, trade-heavy economy whose buyers sit across Asia, Australia and North America. Figures from the World Bank and Payments NZ.

  1. 01

New Zealand's GDP was about US$261.5 billion in 2024, and its population about 5.29 million.[1],[2]

  2. 02

Goods exports were about US$42.1 billion in 2023; China took 26.9%, Australia 12.9%, the United States 12.0% and Japan 5.5%, in UN Comtrade data published by the World Bank.[3]

  3. 03

Payments NZ says the inter-bank clearing systems it governs support payments of more than NZ$8 trillion a year.[4]

  4. 04

In Payments NZ's June 2026 survey of 1,000 adults, 25% preferred paying by smartphone for everyday purchases, up from 15% in 2024, and 11% preferred cash.[5]

  5. 05

The same survey found 40% had changed how they pay to avoid fees or surcharges, worth weighing before a payment link goes into a message.[5]

Industries

What New Zealand sells, and the messages around it

Whether you sell to New Zealand firms, buy from them or run their customer support from India, these are the sectors the country's trade figures and agencies put forward, and the messages that go with each.

  1. 01

    Dairy

Solid milk and cream (about US$4.52bn) and butter and other milk fats (about US$2.57bn) were the two largest export products in 2023.[3]

On WhatsApp: Order and shipment updates for overseas buyers · Documentation reminders · Importer support

  2. 02

    Meat

Frozen boneless beef (about US$2.09bn) and frozen sheep meat (about US$1.50bn) were among the top five export products in 2023.[3]

On WhatsApp: Buyer order confirmations · Shipment status · Delay alerts

  3. 03

    Forestry

Untreated coniferous logs were a top-five export product in 2023, at about US$1.99bn.[3]

On WhatsApp: Harvest and shipping notices · Port-booking updates · Contractor scheduling

  4. 04

    Wine and food

NZTE promotes premium food and beverage as a lead export sector and says New Zealand still wine sells at a 25% premium per bottle to the UK category average (year ended May 2024).[6]

On WhatsApp: Wine-club orders · Release announcements to opted-in members · Cellar-door bookings

  5. 05

    Technology and agritech

NZTE lists technology, agritech, cleantech, renewable energy and manufacturing among New Zealand's export sectors.[6]

On WhatsApp: Customer onboarding · Support tickets · Renewal reminders

  6. 06

    Aerospace and screen

ChristchurchNZ promotes Canterbury's aerospace sector and publishes an aerospace strategy; WellingtonNZ runs a dedicated screen section featuring Wētā Workshop.[7],[8]

On WhatsApp: Parts-order status for international clients · Crew and supplier scheduling · Location notices

Two main islands, one clock, and an outlier

Mainland New Zealand keeps one time zone. The Chatham Islands keep their own, 45 minutes ahead of it.

From India, New Zealand is the far end of the working day: six and a half hours ahead in the southern winter, seven and a half while New Zealand is on daylight time. A 9:00 start in Wellington is 1:30 or 2:30 in the morning in India.

The overlap with an Indian office day is short. Wellington's 17:00 close is 9:30 or 10:30 in India, so promotions are queued in the Indian evening and scheduled for New Zealand's morning, and a support team in India starts early to share an hour or two with its customers.

Wellington is the capital; Christchurch, in Canterbury, is promoted for its aerospace work. Drag the globe to find both.

On InfiQ

The parts of InfiQ that carry the three steps

Consent, identity and unsubscribe are your duties under New Zealand law. These are the tools that make them routine.

  1. Consent records and opt-out enforcement

Express consent is the basis DIA recommends. InfiQ keeps each opt-in's source and time, enforces STOP at platform level even against later imports, and exports the audit trail.

  2. Template manager and library

Draft templates that name your business and carry an opt-out, and track Meta's approval of each one.

  3. Broadcast campaigns

Queue promotions in the Indian evening and schedule them for New Zealand's working day, to opted-in segments.

  4. Shared team inbox

One number for the team answering New Zealand customers, with transfers, private notes and canned replies to make the short shared window count.

  5. Developer API and webhooks

A REST API and signed webhooks keep your CRM in step with the messages you send. Included on Growth, an add-on on Lite.

  6. Guided onboarding

Meta business verification comes first; once it clears, a number is typically live in about two hours.

Getting started

From sign-up to a first New Zealand send

InfiQ serves India-based businesses. If yours is one, follow the timeline; if your business is based in New Zealand, the second track is yours.

  1. From India

    Day one: start the trial

A 7-day Lite trial, no card needed. Begin Meta business verification straight away; it is the slow step.

  2. From India

    Once Meta verifies you

Your number is typically live in about two hours once Meta business verification is complete, and your first templates go in for approval.

  3. From India

    Before the first promotion

Import only contacts with a recorded opt-in, and check each marketing template names your business and offers a free way out.

  4. From India

    First send

Queue it in the Indian evening and schedule it for a New Zealand morning, which falls in India's small hours.

  5. Based in New Zealand

    Talk to sales

InfiQ serves India-based businesses. For a business based in New Zealand, availability goes through sales.

  6. Based in New Zealand

What sales will be clear about

Rupee invoices, customer data processed in India, and support in English and Hindi on India time. InfiQ has no office, entity or staff in New Zealand.

  7. Based in New Zealand

    Your own checks

Weigh processing in India against Principle 12 with your privacy adviser before you decide.

Questions businesses ask about WhatsApp in New Zealand

  1. Q1

Does the Unsolicited Electronic Messages Act apply to WhatsApp broadcasts?

Yes, for commercial messages with a New Zealand link. The Department of Internal Affairs says the Act covers instant messaging alongside email, fax and text, so a WhatsApp promotion needs consent, must identify your business and how to contact it, and must carry a free unsubscribe that works.

  2. Q2

Which consent should we rely on in New Zealand: express, inferred or deemed?

Express consent, wherever you can get it. DIA says inferred consent cannot reasonably be drawn from a single transaction, and deemed consent applies to conspicuously published business addresses. For customers, a recorded WhatsApp opt-in is the basis that holds up, and Meta's policy asks for one anyway.

  3. Q3

How do we prove consent if the Department of Internal Affairs investigates?

Keep a record of where, when and how each person opted in, and the wording they saw. InfiQ stores the opt-in source and time for every contact and exports the audit trail, which is the evidence you would hand over. DIA's enforcement runs from formal warnings to High Court action, with fines of up to NZ$500,000.

  4. Q4

What happens when a New Zealand customer taps STOP?

InfiQ enforces the STOP at platform level, so later broadcasts skip that number, even if it reappears in a later import. The law allows five working days to honour an unsubscribe; use them to remove the person from your other marketing channels, not to keep sending on WhatsApp.

  5. Q5

Can we send WhatsApp templates in te reo Māori?

Not as a te reo Māori template, as Meta's list stood when this page was checked. It includes English (NZL) but not te reo Māori, so approved templates go out in English. Inside the 24-hour customer service window your team can reply in te reo Māori when a customer writes that way.

  6. Q6

We add contact details from a data supplier. What does IPP 3A require of us?

Since 1 May 2026 you must take reasonable steps to tell those people that you collected their information, why, who will receive it and what their rights are. Separately, the spam law needs consent to messages from your business, and Meta needs an opt-in to hear from you, which a supplied list rarely carries.

  7. Q7

When should an Indian team schedule a promotion for New Zealand?

In India's small hours. New Zealand is six and a half hours ahead of India in its winter and seven and a half on daylight time, which runs from 27 September 2026 to 4 April 2027, so 9:00 in Wellington is 1:30 or 2:30 in India. Queue the broadcast the evening before and let the scheduler send it.

  8. Q8

Our business is registered in New Zealand. Can we use InfiQ?

Talk to sales before anything else. InfiQ serves India-based businesses: it invoices in Indian rupees, processes customer data in India and supports customers in English and Hindi on India time. Sales can tell you whether it fits, and you will want to assess processing in India under Principle 12.

  9. Q9

What does a marketing message to a +64 number cost?

On InfiQ it is ₹7.41, because New Zealand sits in Meta's Rest of Asia Pacific market. Utility messages are ₹0.9938, authentication ₹0.9938 and service replies ₹0.9938, all ex-GST, and plans start at ₹999 a month. Service replies have been charged per message since 1 October 2026.
