Messaging Australia on WhatsApp, under a spam law that names instant messages

Australia's spam law already covers WhatsApp, and its regulator has penalised a business over WhatsApp messages. Get consent, identity and unsubscribe right, then time each send across three time zones.

For Indian businesses with customers in Australia, and Australian firms weighing InfiQ: the Spam Act names instant messages, so WhatsApp marketing needs consent, an identified sender and a working unsubscribe. This page covers those duties, the privacy rules around them, three time zones and the cost.

Australia in seven lines

A large, mostly English-speaking market with many home languages and a trade link to India. Figures from the World Bank, the Australian Bureau of Statistics and the Reserve Bank.

Australia's GDP was about US$1.76 trillion in 2024, the 14th largest among individual economies in the World Bank's 2024 current-dollar data.[1]

The estimated resident population was 27,921,150 at 31 March 2026, up 392,700 people (1.4%) over the year.[2]

India took 4.4% of Australia's goods exports in 2023, behind China (32.6%), Japan (9.8%) and Korea (5.7%), in UN Comtrade data published by the World Bank.[3]

Services exports rose 11.0% to A$142.1 billion in calendar 2025.[4]

Greater Sydney (5,638,830 residents) and Greater Melbourne (5,435,590) were the largest capitals at 30 June 2025; Greater Perth grew fastest of the four largest, at 2.4%.[5]

More than 5.5 million people used a language other than English at home in the 2021 Census, led by Mandarin, Arabic, Vietnamese, Cantonese and Punjabi; Punjabi grew fastest, up 80.4% since 2016.[6],[7]

Cash was only 13% of consumer payments by number in 2022 as people switched to cards, mostly by tapping; PayID lets them pay to a mobile number, email address or ABN over the New Payments Platform, which makes funds available in near real time, 24/7.[10],[12],[11]

See it work

Before a WhatsApp campaign goes to Australian numbers

Australia's Spam Act 2003 does not stop at email and SMS. Its definition of an electronic message names instant messaging accounts, so a promotional WhatsApp template is in scope. Tick through what the Act and ACMA expect.

InfiQ keeps the evidence side of this list. Each contact's opt-in source and time are recorded, and a STOP reply is enforced at platform level, even against a list imported later. See consent records.

What InfiQ cannot do is decide whether a given message is promotional or whether your consent would satisfy ACMA. Those calls sit with you and your adviser, which is why the marketing and utility template split matters from the first draft.

Compliance

The rest of the rulebook: privacy, enforcement, what is coming

Two regulators matter. ACMA enforces the Spam Act; the Office of the Australian Information Commissioner oversees the Privacy Act. Here is where each meets a WhatsApp programme.

The Privacy Act 1988 (Cth) and its Australian Privacy Principles govern how organisations handle personal information; most changes in the Information Commissioner's remit made by the Privacy and Other Legislation Amendment Act 2024 commenced on 11 December 2024.[20]

Regulator: Office of the Australian Information Commissioner (OAIC)

  1. Point 1

APP 7 steps aside where the Spam Act applies

APP 7 generally bars using personal information for direct marketing unless an exception applies, such as reasonable expectation or consent, and requires a simple opt-out. It does not apply to the extent the Spam Act or the Do Not Call Register Act 2006 applies, so WhatsApp marketing is judged mainly under the Spam Act.[19]

  2. Point 2

ACMA has penalised a WhatsApp campaign

In June 2025 Tabcorp (TAB) paid A$4,003,270 and entered a court-enforceable undertaking after marketing SMS and WhatsApp messages to VIP customers went out without consent, adequate sender information or an unsubscribe facility.[16]

  3. Point 3

Promotion inside a service message is still promotion

In October 2024 ACMA penalised the Commonwealth Bank A$7.5 million for further spam breaches, including marketing content in messages framed as service messages. Schedule 1's different treatment is for messages of no more than factual information.[17],[14]

  4. Point 4

ACMA's guidance on consent and unsubscribing

ACMA says a request for consent sent by electronic message is itself a commercial message, the sender must be able to prove consent, unsubscribe requests must be honoured within five working days, and the facility must work for at least 30 days without a log-in.[15]

  5. Point 5

The Do Not Call Register does not cover WhatsApp

Registering a number stops telemarketing calls and marketing faxes. The Register's own FAQ says it will not stop SMS marketing, which, like email, MMS and instant messages, is regulated by the Spam Act.[18]

  6. Point 6

Chatbots that make significant decisions: disclosure from 10 December 2026

From 10 December 2026, organisations covered by the APPs will have to describe in their privacy policies the kinds of personal information used in, and the kinds of decisions made by, computer programs that make or substantially assist significant decisions. A WhatsApp bot that approves or declines requests is worth reviewing against it.[22]

  7. Point 7

A privacy tort, and penalties the OAIC can seek

Since 10 June 2025 individuals have a statutory cause of action for serious invasions of privacy. The OAIC can issue infringement notices and apply to court for civil penalty orders.[21],[24]

  8. Point 8

Draft, not law: the next privacy bill

The Attorney-General's Department released an exposure draft Privacy Amendment (Personal Data Protection) Bill 2026 for consultation on 31 August 2026; it remains subject to further consideration by government. A Children's Online Privacy Code, still in development, must be registered by 10 December 2026.[25],[23]

  9. Point 9

Meta's opt-in rule applies on top

Whatever the statute allows, WhatsApp's Business Messaging Policy requires opt-in permission confirming the person wishes to receive messages from you.[26]

  10. A summary of public guidance from the sources cited, not legal advice.

Timing

Three time zones, two daylight-saving rules

Australia runs on Western, Central and Eastern time, and only New South Wales, Victoria, South Australia, Tasmania and the ACT move their clocks in summer. Slide the send time to see where an India-scheduled broadcast lands in Sydney.

From October to April, Sydney is five and a half hours ahead of India; in the southern winter the gap is four and a half. Brisbane stays four and a half hours ahead all year, Adelaide four or five, Darwin four, and Perth two and a half.

So a broadcast set for 10:00 in India reaches Sydney at 15:30 in summer, Darwin at 14:00 and Perth at 12:30. To land in an east-coast morning, the send has to leave in India's small hours: 9:00 in Sydney on daylight time is 3:30 in India.

Broadcasts on InfiQ can be segmented and scheduled, so a practical pattern is two sends, one for the eastern states and one for Western Australia, queued the evening before.

Where Indian businesses meet Australian customers

Six industries the Australian Bureau of Statistics shows at scale or growing, and the WhatsApp messages each one runs on. Every promotional message among them still goes through the checklist above.

Sydney, Melbourne, Brisbane and Perth are Australia's four largest cities, and in summer they sit on three different clocks.

Drag the globe from India across the Indian Ocean. Perth is the nearest of the big cities to India by clock; Sydney and Melbourne, on the far side of the continent, are the furthest.

The Spam Act and the Privacy Act are Commonwealth laws, applied nationally, so the rules on this page do not change at a state border. What changes is the clock.

On InfiQ

What InfiQ handles, and what stays with you

The parts of the platform that map onto Australia's rules and clocks. Deciding what is marketing, and whether your consent holds, remains your call.

  • Consent records and opt-out enforcement

Each contact's opt-in source and time are recorded, STOP replies are enforced at platform level (even against later imports), and the audit trail exports.

ACMA expects the sender to prove consent. Each opt-in's source and time is recorded, STOP is enforced at platform level and the audit trail exports when you need it.

  • Broadcast campaigns

Send approved template campaigns to up to 2,00,000 contacts per broadcast, with segments, scheduling and delivery analytics.

Schedule separate sends for the eastern states and Western Australia, to opted-in segments of up to 2,00,000 contacts per broadcast.

  • Template manager and library

Draft, submit and track WhatsApp message templates for Meta's approval, starting from a library of 1,000+ ready templates in 27 categories.

Keep marketing and factual templates apart from the first draft, so an order update never carries an offer it should not.

  • Shared team inbox

One WhatsApp number answered by a team: 10 users on Lite and 25 on Growth, agent and manager roles, transfers, private notes, labels and canned replies.

An Indian support team answering Australian customers shares one number, with transfers, private notes, labels and canned replies.

Questions businesses ask about WhatsApp in Australia

Does a WhatsApp broadcast count as a commercial electronic message under Australia's Spam Act?+
Yes, when it promotes something. The Spam Act's definition of an electronic message names instant messaging accounts alongside email and telephone accounts, so a WhatsApp promotion needs consent, accurate sender identification and a functional unsubscribe. In June 2025 ACMA penalised Tabcorp over marketing SMS and WhatsApp messages that fell short on all three.
Can consent we collected for Australian email or SMS cover WhatsApp too?+
Sometimes, but do not assume it. Spam Act consent can be express or reasonably inferred, and ACMA expects the sender to prove it, so check what people actually agreed to. Meta's WhatsApp policy separately requires opt-in permission confirming they wish to receive messages from you, which is why a fresh opt-in that names WhatsApp is the safer record.
Should we wash our WhatsApp list against the Do Not Call Register?+
No. The Do Not Call Register covers telemarketing calls and marketing faxes, and its own FAQ says registering a mobile number will not stop SMS marketing. Instant messages sit with SMS and email under the Spam Act. What protects you on WhatsApp is consent you can prove and an unsubscribe that works.
How fast must an Australian customer's STOP reply take effect?+
ACMA's guidance is within five working days, with the unsubscribe facility working for at least 30 days after the message and no log-in required. On InfiQ a STOP reply is enforced at platform level, so later broadcasts skip that number, even if it reappears in a list imported afterwards.
Our WhatsApp chatbot approves or declines requests. What changes on 10 December 2026?+
From that date, organisations covered by the Australian Privacy Principles must say in their privacy policies what kinds of personal information such programs use and what kinds of decisions they make, where the programs make or substantially assist significant decisions. Check whether your bot is in that scope and update the policy before then.
Can we time broadcasts for Perth separately from Sydney?+
Yes. Broadcasts on InfiQ can be segmented and scheduled, so Western Australia and the eastern states can go out as separate sends. Remember that the east-coast gap moves with daylight saving: Sydney is five and a half hours ahead of India in summer and four and a half in winter, while Perth is two and a half all year.
How much is a WhatsApp promotion to a Sydney or Perth number?+
On InfiQ a marketing message to any Australian number costs ₹7.41, because Australia is in Meta's Rest of Asia Pacific market. Utility messages are ₹0.9938, authentication ₹0.9938 and service replies ₹0.9938, all ex-GST, on top of a plan from ₹999 a month. Service replies have been charged per message since 1 October 2026.
We are an Australian company. Can we sign up with InfiQ directly?+
Talk to sales first. InfiQ serves India-based businesses: it invoices in Indian rupees, processes customer data in India and supports customers in English and Hindi on India time, with no office or staff in Australia. Sales will tell you whether InfiQ can work for you before you commit to anything.
With scam messages about, how do Australian customers know our WhatsApp is genuine?+
Start with identity. Meta approves your display name during onboarding, and the Spam Act already requires each commercial message to identify you accurately. InfiQ can prepare and submit a green tick request, though Meta decides who receives it. Never ask for passwords or one-time codes in a promotion, and send payment requests only to customers who expect them.
