WhatsApp Business API for South Africa: ask once, then message

POPIA lets you ask a new contact for marketing consent once, and the 2025 amended Regulations list WhatsApp as a way to ask. Get that one message right and the rest of the programme follows.

Compliance

POPIA section 69, line by line

South Africa's rule on electronic direct marketing is specific, and the Information Regulator has begun enforcing it. It does not name WhatsApp, but the Regulator treats its list of channels as open.

Section 69(1) of the Protection of Personal Information Act 4 of 2013 prohibits direct marketing by 'any form of electronic communication, including automatic calling machines, facsimile machines, SMSs or e-mail' unless the person has consented or is an existing customer.[9],[10]

Regulator: Information Regulator (South Africa)

  1. Point 1

    Non-customers: one request, once

A responsible party may approach a person who is not a customer only once to ask for consent, and only if that person has not withheld it before (section 69(2), as the Regulator's guidance note explains).[10]

  2. Point 2

Existing customers: similar products, with a way to object

The customer route needs contact details obtained in a sale, marketing of your own similar products or services, and a free chance to object both when the details were collected and in every message (section 69(3)).[9]

  3. Point 3

Every message names you and offers an opt-out

Each direct-marketing message must carry the sender's identity and contact details for opting out (section 69(4)).[9]

  4. Point 4

WhatsApp is a listed channel for the consent request

According to Moonstone's summary of the April 2025 amendments to the POPIA Regulations (Government Gazette 52523, Notice 6126), consent may be requested on a form substantially similar to Form 4 by any expedient, free and accessible means, WhatsApp among them; telephone consent must be recorded electronically; and an opt-out option does not constitute consent.[11]

  5. Point 5

    The channel list is open

The Regulator's non-binding guidance note of December 2024 treats phone calls as electronic communication and gives SMS, email, push notifications and direct messages on Instagram or LinkedIn as examples, saying the list is not exhaustive. POPIA itself names no messaging app, so applying section 69 to WhatsApp is an interpretation, and a well-supported one.[10]

  6. Point 6

    Enforcement has begun

The Regulator's first direct-marketing enforcement notice, against FT Rams Consulting, found breaches of section 69(1) and (2) for repeated marketing emails sent without prior consent.[12]

  7. Point 7

    No national do-not-contact registry yet

Section 11 of the Consumer Protection Act gives everyone the right to refuse or pre-emptively block direct marketing and provides for a national opt-out registry, which has not been set up; the only opt-out database is the one DMASA runs for its members. Draft amendments published on 28 October 2024 would create a registry at the National Consumer Commission; their final status was not verified for this page. Either way, the Regulator says section 69 still applies where no block is registered.[13],[14],[10]

South Africa's economy, briefly

Slow growth, a large online population and a deep financial sector: the context for any messaging budget.

The World Bank describes South Africa as the second-largest economy in Africa.[1]

GDP grew 0.5% in 2024 and 1.1% in 2025; the economy grew 0.5% in the first quarter of 2026 and contracted 0.2% in the second.[1]

About 63 million people live in South Africa, by Stats SA's 2024 mid-year estimate; Gauteng holds the largest share, 25.3%.[2]

Kepios counted 51.7 million internet users at the end of 2025, 79.6% of the population.[5]

The Reserve Bank's 2023 Payments Study finds cash payments highly complemented by debit cards, with banking apps gaining traction as a way to pay.[7]

Twelve official languages, four template codes

The government lists 12 official languages of equal status. Meta's template list covers English, a South African English variant, Afrikaans and isiZulu.

isiXhosa, Sesotho, Setswana, Sepedi and the other official languages are not on Meta's template list, so templates for those customers go out in English. Replies inside the 24-hour customer service window can be in any language your agents write.

Ask for the preferred language at opt-in and store it, so every template and every reply starts in the right one.

Questions businesses ask about WhatsApp in South Africa

Is a WhatsApp opt-in box at checkout enough for POPIA section 69?+
It can be, if it is an active choice. According to Moonstone's summary of the April 2025 amended Regulations, an opt-out option does not constitute consent, so a pre-ticked box or 'untick to stop' wording will not do. Name WhatsApp and the kind of messages, and keep the time, page and wording of each yes.
Can we send the one-time consent request to a new lead on WhatsApp?+
Only in the right place. The amended Regulations list WhatsApp among the channels for requesting consent (per Moonstone's summary), and section 69(2) allows one approach. But Meta's policy requires that the lead has shared their number and opted in to your messages first, so ask inside a conversation they started, not in a cold template.
Under section 69(3), can we message existing customers about similar products without asking again?+
Yes, within section 69(3): the contact details must come from a sale, the messages must be about your own similar products or services, and the customer must have had a free chance to object when you collected the details and must get one in every message. Meta's opt-in requirement for WhatsApp still applies on top.
Will a national do-not-contact registry cover WhatsApp marketing?+
There is no such registry yet. The Consumer Protection Act provides for one, and draft regulations published in October 2024 would create it at the National Consumer Commission, but their final status was not verified for this page. Section 11's right to block marketing already applies, and the Regulator says section 69 applies whether or not a block is registered.
Can we send WhatsApp templates in Afrikaans or isiZulu?+
Yes. Afrikaans (af) and isiZulu (zu) are on Meta's template list, alongside English and a South African English code (en_ZA). Each language version is approved separately. isiXhosa and the other official languages are not on the list, so use English templates and reply in those languages inside the 24-hour window.
What should our records show if the Information Regulator investigates?+
Who consented, when, through which channel and to what wording; the single consent request sent to each non-customer; and every opt-out with the date messages stopped. The Regulator's first section 69 enforcement notice concerned marketing sent without prior consent. InfiQ's consent records store the opt-in source and time, enforce STOP and export the audit trail.
Can a company in Johannesburg or Cape Town sign up with InfiQ directly?+
Talk to sales first. InfiQ serves India-based businesses: it bills in rupees, keeps customer data in India and supports teams in English and Hindi on India time. Sales will tell you plainly whether it can work with a business registered in South Africa.
