01 · How it works, in 5 steps
How does the WhatsApp Business Solution Terms work?
- 1
Find the current documents
Read the Meta Terms for WhatsApp Business Platform, the WhatsApp Terms for WhatsApp Business Platform and the Business Messaging Policy as one set. Note their dates (23 September 2026) and keep a copy of what you accepted.
- 2
Map data flows to the data-use clause
List where WhatsApp data goes — CRM, analytics, ad audiences, LLM prompts, training sets — and remove any profiling, sharing, resale or training use the terms forbid.
- 3
Test AI features against section 4.7
If AI is the product you sell to the public, WhatsApp may be off-limits for it. If AI answers your own customers about your business, document that it is incidental to that service.
- 4
Align vendor contracts
Bind your BSP, CRM and AI vendors to the same restrictions, and make sure your data processing agreements reflect Meta's role as processor for hosted messages.
- 5
Plan for suspension and exit
Keep your own records of opt-ins, templates and the conversations you must retain, since Meta deletes platform data after termination and offers no backup.
02Try it
Hands-on: use the controls to work through it yourself.
Which document governs your programme?

Hop 6 of 6: the payload is in layer 6, Indian law. The DPDP Act and sector rules apply alongside the contract; complying with them is your responsibility.
03What is the WhatsApp Business Solution Terms?
The WhatsApp Business Solution Terms are the contract a business accepts to use the WhatsApp Business Platform — the Cloud API and the products around it. Where the WhatsApp Business Messaging Policy governs day-to-day sending behaviour, the terms set the legal relationship: who contracts with whom, how platform data may be used, each side's security and payment duties, and when Meta may suspend or end access. A business accepts them when it signs up, whether directly or through a BSP.
The documents have been restructured. The old WhatsApp Business Solution Terms address now leads to the Meta Terms for WhatsApp Business Platform, last updated on 23 September 2026, which sits alongside the WhatsApp Terms for WhatsApp Business Platform (effective the same day) and incorporates the Business Messaging Policy and Meta's developer documentation. Businesses outside the US and Canada contract with Meta Platforms Ireland Limited. Where Meta processes personal data on a business's behalf, as with Cloud API message hosting, the Meta Global Processor Terms apply — Meta's counterpart to a Data Processing Agreement — and optional Meta Business Agent use adds its own terms.
Several clauses matter in practice. Platform data may not be used to track or build profiles of WhatsApp users, shared or sold to third parties, scraped, or used to create, train or improve AI models, except to fine-tune a model for the business's exclusive use. The AI providers clause — in force since 15 January 2026 and now section 4.7 — bars providers and developers of AI from using the platform where AI is the primary rather than incidental functionality, as Meta determines. A business may still hire an AI provider as its solution provider, and an AI Agent that serves its own customers is unaffected.
The terms also give Meta wide powers. The business is responsible for all activity under its accounts and must keep credentials secure. Meta may suspend access for unpaid fees or for breaches by the business or its clients, terminate for convenience on notice, and after termination delete platform data from the business portfolio, except what it must keep for legal, tax or audit reasons. It provides no archive or backup service.

05 · Mistakes to avoid
Common mistakes with the WhatsApp Business Solution Terms
Citing the old name and an old copy
The Solution Terms address now leads to the Meta Terms for WhatsApp Business Platform. Contracts, privacy notices and vendor reviews should reference the current documents and dates.
Building AI as the product
If AI is the primary functionality you offer, Meta can refuse it however good the bot is. Scope assistants to your own business's customers and services.
Training shared models on chat data
Pooling transcripts across clients to train or improve a model breaches the data-use clause. Fine-tune only for a single business's exclusive use, on its own data.
Relying on Meta as your archive
Meta deletes platform data after termination and offers no backup. Keep your own copies of consent records, templates and conversations you are required to retain.
Assuming the BSP signed for you
Your BSP has its own agreements, but your business still accepts the terms and is responsible for all activity under its accounts.
06 · Why it matters
Why does the WhatsApp Business Solution Terms matter?
The terms decide things no feature flag can change: whether your AI product is allowed on WhatsApp at all, whether chat data may feed analytics or model training, and what happens to your data if Meta ends the relationship. Legal teams sign once and move on; product teams then build a general-purpose assistant, a data-resale feature or a cross-client training pipeline the contract forbids. Reading the AI providers, data-use and termination clauses before building is far cheaper than rebuilding after a suspension.
07Example: A Pune startup checks its roadmap
A Pune software startup sells a WhatsApp customer-support bot to retailers and plans a second product: a consumer "ask me anything" assistant on its own number. Its counsel reads section 4.7 of the Meta Terms for WhatsApp Business Platform. The retailer bot answers each retailer's own customers about orders and returns, so it stays. The consumer assistant would make AI the primary functionality, so the team ships it as a web app instead. A second finding stops a plan to pool chat transcripts across clients to train one shared model; instead, any fine-tuning uses one retailer's own data, for that retailer alone.
