WhatsApp Business API for Kuwait, one CITRA consent step at a time

No general data-protection law, one telecoms regulator's privacy rule, and a 24-hour breach clock. Here is what that means for a WhatsApp list built from India.

For Indian businesses with customers in Kuwait, and Kuwaiti firms weighing an Indian provider: the consent cycle CITRA's 2024 regulation sets out, what Kuwaiti law does not cover, why opt-ins should be in Arabic and English, and what a message to a +965 number costs.

Compliance

Kuwait's rules, and the gaps in them

What exists, whom it binds, what it costs to get wrong, and what is simply not there.

Kuwait has no comprehensive data-protection law and no national data protection authority; its main privacy instrument is CITRA's Data Privacy Protection Regulation, issued by Administrative Decision No. 26 of 2024.[3]

Regulator: Communication and Information Technology Regulatory Authority (CITRA)

  1. Point 1

    Who the regulation binds

It applies to CITRA-licensed service providers in the telecoms sector, but defines 'service provider' broadly enough to cover anyone operating a website, smart application or cloud service.[3]

  2. Point 2

    No rule written for marketing

DLA Piper lists no specific provisions on electronic marketing in Kuwait. The nearest rules are the regulation's general consent requirement and the E-Commerce Law's general ban on processing information unlawfully without consent; neither names messaging apps.[3]

  3. Point 3

    Penalties under CITRA's own law

Breaches can bring one to five years' imprisonment and/or fines of KWD 500 to KWD 20,000 under the law that established CITRA.[3]

  4. Point 4

    Meta's opt-in rule applies anyway

Whatever Kuwaiti law leaves open, Meta's WhatsApp Business Messaging Policy lets a business message someone only after they have shared their number and opted in to its messages.[9]

Market brief

An oil economy in a hard year

The IMF's February 2026 picture, its October forecast, and the payment rails your customers use.

  1. 01

In February 2026 the IMF described an incipient recovery: real GDP grew 1.7% year on year in the second quarter of 2025, on 3.1% non-oil growth, after a contraction in 2024.[5]

  2. 02

The IMF calls the economy's heavy dependence on oil the main source of risk, and welcomes the diversification goals of Vision 2035.[5]

  3. 03

Its October 2026 World Economic Outlook projects Kuwait's economy to contract 16.7% in 2026 and to rebound 17.1% in 2027.[6]

  4. 04

The IMF named Kuwait among the Gulf economies most affected by the closure of the Strait of Hormuz, because it has limited capacity to route exports around the strait.[7]

  5. 05

KNET, set up in 1992 with local banks, runs Kuwait's shared banking payment services; Wamd, its instant-payment service with Kuwaiti banks, launched in 2024.[8]

Who sends what in Kuwait

Three parts of the economy the sources describe, and the messages that fit them.

Oil and its supply chain

The economy depends heavily on oil, and risks reach it mainly through oil prices and OPEC+ production, the IMF says.[5]

  • Crew scheduling
  • Safety notices
  • Procurement updates

Retail, services and construction

Non-oil activity grew 3.1% year on year in the second quarter of 2025; the IMF urges reforms to lift the private sector.[5]

  • Order confirmations
  • Delivery tracking
  • Maintenance requests

Banking and payments

KNET's network carries card payments at the point of sale, introduced in 1994, and Wamd adds instant transfers through banks' apps.[8]

  • Transaction alerts
  • OTPs
  • Card-servicing chat

Two languages, because the regulation names them

CITRA's regulation asks for the explanation of services and terms in English and Arabic. Build the same pair into your templates.

Meta approves each language version of a template separately, so a bilingual programme means two versions of every template and a record of which one each contact chose.

Inside the 24-hour service window replies need no template, so agents can answer in the language the customer used; each reply is charged as a service message.

Questions businesses ask about WhatsApp in Kuwait

Does CITRA's 2024 privacy regulation cover a business that only sends WhatsApp messages?+
Possibly; it depends on how broadly 'service provider' is read. The regulation is addressed to CITRA-licensed providers, but DLA Piper notes that its definition is wide enough to cover anyone operating a website, smart application or cloud service. Following its consent steps costs little and also satisfies Meta's opt-in rule.
Is there a Kuwaiti law on quiet hours or consent for promotional messages?+
We found none to point to. DLA Piper lists no Kuwaiti provisions specific to electronic marketing, and we found no sourced quiet-hours rule. Opt-in consent is still required by Meta's policy, and sending promotions during the working day is simply good manners.
Do our Kuwait opt-in notices have to be in both Arabic and English?+
If the CITRA regulation applies to you, yes. It requires providers to explain their services and terms in English and Arabic, and to state the purpose and use of the data, before collecting it and obtaining consent. A two-language opt-in also matches the two template versions you will send.
What must happen when a Kuwaiti customer withdraws consent?+
Messages must stop, and under the CITRA regulation the provider must delete or destroy the information. InfiQ blocks further messages to anyone who replies STOP, even if they are imported again later. Plan how your team will delete the rest of that person's data.
Can a WhatsApp payment link work with KNET cards or Wamd?+
That depends on the payment gateway behind the link, not on WhatsApp. InfiQ does not offer in-chat payments; teams send a gateway link in a template or reply. KNET runs Kuwait's shared banking payment services, and Wamd, launched in 2024, makes instant transfers through banks' apps.
What does each WhatsApp message to a Kuwaiti number cost through InfiQ?+
Marketing messages cost ₹6.97, utility ₹3.87, authentication ₹3.87 and service replies ₹3.87, at InfiQ's Kuwait rate in rupees, excluding GST. Service replies have been charged per message since 1 October 2026. Plans start at ₹999 a month.
Should the 2026 downturn change how we budget for Kuwait messaging?+
Budget on the current forecast, not last year's. The IMF's October 2026 outlook projects a 16.7% contraction in 2026 and a 17.1% rebound in 2027. On InfiQ the plan fee is fixed and messages are charged only when delivered, so promotional volume can follow demand while order and payment updates continue.
Can a Kuwaiti business use InfiQ, or is it only for Indian companies?+
InfiQ serves India-based businesses, so a Kuwaiti company starts with sales. InfiQ invoices in rupees, processes customer data in India and supports customers in English and Hindi on India time, and has no office or entity in Kuwait. Sales can say whether availability outside India covers your case.
