Market brief

Kenya, measured by its own statistics bureau

Most figures here come from the KNBS Economic Survey 2026. The two mobile-money numbers come from different sources that count different things, so they are kept apart.

  1. 01

Real GDP grew 4.6% in 2025 after 4.7% in 2024, with positive growth in every sector, the KNBS reports.[1]

  2. 02

Agriculture, forestry and fishing make up over 20% of the economy.[1]

  3. 03

The World Bank expects 4.6% growth in 2026 and 4.4–4.8% over the medium term.[2]

  4. 04

Mobile subscriptions reached 78.4 million in 2025, 146.99 per 100 inhabitants, and mobile money subscriptions 51.4 million (KNBS).[1]

  5. 05

The Central Bank of Kenya counted 95.31 million registered mobile money accounts and 563,605 active agents in August 2026; registered accounts are a different measure from subscriptions.[4]

  6. 06

About 57.8 million people lived in Kenya in October 2025, with 23.4 million internet users (40.5%), per UN data and Kepios via DataReportal.[3]

Language

One payment receipt, in Kiswahili and English

Meta accepts templates in both of Kenya's official languages. Write the Kiswahili version as its own message rather than a word-for-word copy of the English one.

The Kiswahili sample tells the time the Kiswahili way: saa nne asubuhi is 10 am and saa nane mchana is 2 pm, because the hours are counted from six in the morning. Writing the window like that, rather than as 10:00, is what makes the template read as written for the customer.

Store each contact's language at opt-in and send that version. Inside the 24-hour customer service window your agents can answer in whatever mix of Kiswahili and English the customer uses.

Compliance

Express consent, and an opt-out in every message

Kenya's Data Protection Act treats marketing as a commercial use of personal data that needs express consent, and its 2021 Regulations spell out the opt-out.

Section 37(1) of the Data Protection Act, 2019 bars using personal data for commercial purposes unless express consent has been sought and obtained, or written law allows it. The Act dates from 25 November 2019; its General Regulations were gazetted on 31 December 2021.[7],[8]

Regulator: Office of the Data Protection Commissioner (ODPC)

  1. Point 1

    What express consent means

The Act defines consent as an 'express, unequivocal, free, specific and informed indication' of the person's wishes, by a statement or a clear affirmative action.[7]

  2. Point 2

A sale message is direct marketing

Regulation 14 counts sending an electronic message about a sale to a data subject as direct marketing, a commercial use of their data.[8]

  3. Point 3

    Consent plus a simple opt-out

Regulation 15 links direct marketing to consent and a simplified opt-out mechanism, and rules it out for someone who has already opted out. Every direct-marketing message must say where to send a free request to stop.[8]

  4. Point 4

Opting out by reply is allowed

Regulations 16 and 17 require an opt-out that is clear, quick, free or of nominal cost and accessible to persons with disabilities, and let marketers accept an opt-out sent as a reply to a text message. The Regulations speak of text and electronic messages generally and do not mention WhatsApp, so treating a WhatsApp STOP reply the same way is an interpretation.[8]

  5. Point 5

Marketing without consent is an offence

Under Regulation 15(4), using personal data for commercial purposes without consent is an offence, punishable by a fine of up to KSh 20,000, up to six months' imprisonment, or both.[8]

  6. Point 6

    Guidance notes worth reading

The ODPC publishes sector guidance, including notes on consent (2025), digital credit providers, the communication sector and cross-border data transfers (2026).[9],[10]

  7. Point 7

Draft: the Communications Authority's consumer rules

In September 2026 the Ministry of ICT and the Communications Authority published draft Kenya Information and Communications (Consumer Protection) Regulations, 2026 for stakeholder validation. Draft regulation 16 would bar unsolicited direct-marketing communications without prior consent and require sender identification and a working opt-out. It is a draft, not in force, and it does not name OTT apps.[11]

  8. Point 8

    Meta requires opt-in as well

The WhatsApp Business Messaging Policy lets a business message someone only after they have shared their number or username and opted in to receive its messages.[13]

  9. A summary of public guidance from the sources cited, not legal advice.

On InfiQ

What you run on InfiQ for Kenya

Six live capabilities and the Kenyan requirement or habit each one meets.

  1. Consent records and opt-out enforcement

Regulation 15 expects consent and a working opt-out. The record keeps each opt-in's source and time and enforces STOP replies at platform level.

  2. Template manager and library

Kiswahili and English versions are separate templates; draft them side by side and track Meta's approval of each.

  3. Broadcast campaigns

Harvest-season and holiday campaigns go to opted-in segments; Nairobi is two and a half hours behind India, so schedule accordingly.

  4. Shared team inbox

One number for sales and support, answered by a team with roles, transfers and labels.

  5. Integrations over the API

CRMs, loan systems and online stores connect through InfiQ's API and webhooks today; native one-click connectors are still in development.

  6. Guided onboarding

InfiQ guides the verification itself; go-live is about two hours once Meta business verification is complete.

Questions businesses ask about WhatsApp in Kenya

  1. Q1

What counts as express consent for WhatsApp marketing under Kenya's Data Protection Act?

An express, unequivocal, free, specific and informed indication of the person's wishes, given by a statement or a clear affirmative action, which is how the Act defines consent. In practice that means an unticked box they tick, or a 'Yes' reply to a clear question, naming WhatsApp and the kind of messages, recorded with its time and source.

  2. Q2

Does a 'Reply STOP to opt out' line meet Regulation 15?

It addresses the core of it. Regulation 15 wants every direct-marketing message to say where to send a free request to stop, and Regulations 16 and 17 let recipients opt out by replying to a text message; treating a WhatsApp reply the same way is a reasonable reading. Add a 'Stop promotions' button so the opt-out is one tap; InfiQ enforces it at platform level.

  3. Q3

Can customers pay with M-PESA from a WhatsApp conversation?

Not inside the chat on InfiQ, which does not offer in-chat payments. Put the amount, order number and your Paybill or Till number, or a link from your payment provider, in a utility template, then connect the provider through InfiQ's API and webhooks so a receipt goes out when the payment arrives.

  4. Q4

Can we send WhatsApp templates in Kiswahili?

Yes. Swahili is on Meta's template list under the code sw, and Kiswahili and English are Kenya's official languages under Article 7 of the Constitution. Each language version of a template is approved separately, so submit the Kiswahili and English versions together.

  5. Q5

Will the Communications Authority's 2026 consumer-protection regulations change WhatsApp promotions?

Not yet. The revised Kenya Information and Communications (Consumer Protection) Regulations, 2026 were published in September 2026 as a draft for stakeholder validation and are not in force. The draft does not name OTT apps; its prior-consent and opt-out principles match what the Data Protection Act's Regulations already require.

  6. Q6

What does the ODPC's cross-border guidance mean for customer data processed in India?

Read it before you start. InfiQ processes customer data in India, and WhatsApp messages run on Meta's Cloud API, so a Kenyan business using InfiQ would be sending personal data abroad. The ODPC published a guidance note on cross-border transfers in 2026; take it, with your own data map, to your adviser.

  7. Q7

What should a digital lender check before messaging borrowers on WhatsApp?

Start with the ODPC's Guidance Note for Digital Credit Providers, which is written for lenders that contact borrowers and their contacts, and with Regulation 15's consent and opt-out rules. Keep reminders to the borrower who opted in, and keep every reminder's wording and time on record.

  8. Q8

Can a Nairobi-registered company use InfiQ for its own customers?

Talk to sales first. InfiQ serves India-based businesses: it bills in rupees, keeps customer data in India and supports teams in English and Hindi on India time. Sales will tell you plainly whether it can work with a business registered in Kenya.
