Romania is priced as its own Meta market, and its e-privacy law asks for prior express consent from companies as well as people. Start with the numbers, then the rule that decides which of them you may send.

Article 12: Romania's consent rule for electronic messages

Romania's e-privacy law sits beside the GDPR and the national law that implements it. Article 12 is the part a WhatsApp programme has to plan around.

Article 12(1) of Law No. 506/2004 prohibits commercial communications by automated calling systems, fax, e-mail or any other method using publicly available electronic communications services, unless the subscriber or user gave prior express consent.[1]

Regulator: ANSPDCP (National Supervisory Authority for Personal Data Processing)

  1. Point 1

WhatsApp is not named, but the wording is wide

The law reaches 'any other method using publicly available electronic communications services' and does not name messaging apps. Applying it to WhatsApp is an interpretation; the safe course is to treat WhatsApp marketing to Romanian numbers as covered.[1]

  2. Point 2

    Company subscribers are covered too

Article 12(4) applies the consent and identification rules to subscribers that are legal persons as well, so commercial messages to Romanian companies need prior consent.[1]

  3. Point 3

The customer exception is written for e-mail

Article 12(2) lets a business use e-mail addresses obtained directly from a customer in a sale to market similar products, if the customer can object simply and free of charge when the address is collected and in each message. It speaks of e-mail addresses; whether it stretches to WhatsApp numbers is a question for counsel.[1]

  4. Point 4

Say who you are, and how to stop

Article 12(3) says commercial e-mails must not hide the sender's identity and must give a valid address for stop requests. Hold WhatsApp messages to the same standard: a recognisable business name and an opt-out that works.[1]

  5. Point 5

    ANSPDCP enforces Article 12

Staff of ANSPDCP, the data-protection authority, find and sanction breaches of Article 12 on unsolicited communications.[1],[3]

  6. Point 6

The GDPR, with Romania's own measures

The GDPR has applied since 25 May 2018. Law 190/2018 sets national measures implementing specific GDPR provisions, for example on national identifiers, employee data, data protection officers, certification and public bodies.[4],[2]

  7. Point 7

    Check the consolidated text

The ANSPDCP-hosted text of Law 506/2004 shows no consolidation date. Check the current consolidated version before quoting it.[1]

  8. Point 8

    WhatsApp's own opt-in rule

Meta's WhatsApp Business Messaging Policy requires a person's opt-in before a business messages them, whatever Romanian law says about the message.[5]

  9. A summary of public guidance from the sources cited, not legal advice.

Romania in sourced lines

A country of sharp regional contrasts, large EU investment and a messaging habit that is still spreading.

The IMF estimates Romania's 2025 GDP at about US$429 billion and GDP per head at about US$22,540. Both are estimates.[6]

Productivity rose to more than 80% of the EU average in 2023, ranging from 154% in the Bucharest-Ilfov capital region, which also has the country's highest regional employment rate, to 47% in the North-East.[7]

Romania has access to more than EUR 90 billion of EU funding: about EUR 44 billion from cohesion funds, about EUR 20 billion from the common agricultural policy, and EUR 12.1 billion in grants plus EUR 14.9 billion in loans from the Recovery and Resilience Facility.[7]

The population was an estimated 19,041,322 on 1 January 2026. Romania uses the leu and, according to the EU profile, has been a Schengen member since 31 March 2024.[8],[12]

Eurostat counts 72.22% of people in Romania using instant messaging in 2025, up from 63.00% in 2024, against 82.31% across the EU. The survey covers all messaging apps, not WhatsApp alone.[11]

Romanian is the official language under Article 13 of the Constitution. English is common in IT and outsourcing, though we found no figure for how common.[13]

  • Interview scheduling for opted-in candidates
  • Onboarding messages
  • Employee helpdesk
AgricultureCrop and animal production generated 2.3% of gross value added in 2024 (provisional); common agricultural policy funding is around EUR 20 billion for 2021 to 2027.[10],[7]

Romanian first, English where chosen

Meta accepts templates in Romanian and approves each language version separately.

Write consumer templates in Romanian with full diacritics (ă, â, î, ș, ț); they are ordinary characters in a WhatsApp template, and Romanian readers notice when they are missing.

Keep English versions for business contacts who use it. Replies inside the 24-hour service window can be in either language, whichever your agent and customer share.

On InfiQ

What a Romanian programme runs on

The parts of InfiQ that matter most for software, automotive and retail teams messaging Romania.

  • Consent records and opt-out enforcement

Each contact's opt-in source and time are recorded, STOP replies are enforced at platform level (even against later imports), and the audit trail exports.

Article 12 asks for prior express consent, from companies too. InfiQ stores each opt-in's source and time and enforces STOP at platform level.

  • Shared team inbox

One WhatsApp number answered by a team: 10 users on Lite and 25 on Growth, agent and manager roles, transfers, private notes, labels and canned replies.

Romanian- and English-speaking agents share one number; transfers and labels route each conversation to someone who speaks the customer's language.

  • Template manager and library

Draft, submit and track WhatsApp message templates for Meta's approval, starting from a library of 1,000+ ready templates in 27 categories.

Romanian and English versions of each template, drafted and tracked through Meta's approval.

  • Developer API and webhooks

A REST API with scoped keys, idempotency keys and per-key rate limits, plus HMAC-SHA256-signed webhooks retried for 24 hours. Included on Growth, an add-on on Lite.

Software teams trigger login codes and product notifications from their own systems, with signed webhooks back.

  • Broadcast campaigns

Send approved template campaigns to up to 2,00,000 contacts per broadcast, with segments, scheduling and delivery analytics.

Campaigns only to the consented segment, scheduled in Romanian local time.

  • Guided onboarding

InfiQ guides Meta business verification, number registration and display-name approval; with verification done, a number is typically live in about two hours.

Meta business verification first; once it is complete, a number is typically live in about two hours.

Questions businesses ask about WhatsApp in Romania

Does Romania's Law 506/2004 apply to WhatsApp marketing?+
Plan as if it does. Article 12(1) covers commercial communications by e-mail 'or any other method using publicly available electronic communications services', and requires prior express consent. WhatsApp is not named, so applying it to WhatsApp is an interpretation, but the wording is broad.
Is Romania's existing-customer exception available for WhatsApp messages?+
Unclear, so do not rely on it without advice. Article 12(2) lets a business market similar products to customers whose e-mail addresses it obtained in a sale, with a simple, free way to object. It is written for e-mail addresses, and whether it covers WhatsApp numbers is a question for counsel.
Do B2B messages to Romanian companies need consent?+
Yes. Article 12(4) applies the consent and identification rules to subscribers that are legal persons, so a WhatsApp offer to a Romanian company needs prior express consent just as a consumer offer does.
Who would investigate a complaint about our WhatsApp messages in Romania?+
ANSPDCP, Romania's data-protection authority, whose staff find and sanction breaches of Article 12 on unsolicited communications. It also supervises the GDPR, so the consent record and the wider data handling would usually be looked at by the same body.
What does a WhatsApp marketing message to a +40 number cost?+
₹7.56 per delivered marketing message on InfiQ, ex-GST, against ₹0.94 for an Indian number. Utility messages cost ₹2.54, authentication ₹2.54 and service replies ₹2.54. Plans start at ₹999 a month.
Can one inbox serve Romanian- and English-speaking customers?+
Yes. The shared team inbox puts every conversation on one number, and transfers and labels let a conversation move to an agent who speaks the customer's language. Lite includes 10 users and Growth 25.
Can Romanian templates use ș, ț and the other diacritics?+
Yes. Romanian is on Meta's template language list (code ro), and ă, â, î, ș and ț are ordinary characters in a template. Use the comma-below forms of ș and ț rather than the cedilla look-alikes, which some readers notice.
