WhatsApp Business API in Chile, ahead of the new data law

On 1 December 2026, Chile moves from a 1999 privacy law to a modern one with its own enforcement agency. Consent you collect for WhatsApp now should already meet the new standard.

For Indian businesses with Chilean customers, and Chilean companies weighing InfiQ: what Ley 19.628 requires today, what Ley 21.719 changes from 1 December 2026 and who will enforce it, how Chile's clock changes affect sends, and what messages to Chile cost.

See it work

From Ley 19.628 to Ley 21.719

Chile's privacy law is being rebuilt, with a fixed start date and a new regulator. Step through what applies when.

For a WhatsApp programme the date that matters is 1 December 2026. From then, consent has to be free, informed and specific, given in advance and unequivocally, and you carry the burden of proving it.

Two other changes arrive with it. Legitimate interest becomes a lawful basis, with the person entitled to know which interest you rely on; and people gain a right to object to processing for direct marketing, profiling included.

Review your opt-in records now. Where one would not meet the new standard, ask again at the next natural touchpoint, such as checkout or a conversation the customer starts. WhatsApp's own policy requires an opt-in under either law.

Compliance

Consent in Chile, before and after 1 December

Neither data law mentions messaging apps, so applying them to WhatsApp is an interpretation. Consumer law adds a rule about stopping promotions.

Ley 19.628 on the Protection of Private Life (1999) governs personal data until 30 November 2026. From 1 December 2026, Ley 21.719 amends it and creates the Agencia de Protección de Datos Personales; until then Chile has no dedicated data-protection authority.[2],[1]

Regulator: Agencia de Protección de Datos Personales (from 1 December 2026)

  1. Point 1

    Today: express, written consent

Under Article 4 of Ley 19.628, processing needs legal authorisation or the person's express consent, given in writing after being told the purpose, and it can be revoked in writing.[2]

  2. Point 2

    Today's exception for direct-response marketing

No authorisation is needed for certain data from publicly accessible sources, including where it is needed for direct-response commercial communications or direct selling.[2]

  3. Point 3

From December: a higher bar for consent

Ley 21.719 requires consent that is free, informed and specific, given in advance and unequivocally, and the controller must be able to prove it had consent (amended Article 12).[1]

  4. Point 4

From December: legitimate interest, and a right to object

The new law adds lawful bases including legitimate interest, with the person entitled to be told which interest is relied on (amended Article 13), and gives people a right to object to processing done only for direct marketing, including profiling.[1]

  5. Point 5

A registry of sanctions, and an old register retired

The Agency will keep a public National Registry of Sanctions and Compliance, and the Civil Registry's old database register under Article 22 of Ley 19.628 is to be eliminated before the new rules take effect.[1]

  6. Point 6

    Consumer law: stop means stop

Article 28 B of Ley 19.496, in the consolidated text dated April 2021, requires suppliers sending promotions by post, fax, calls or telephone messaging services to offer an expedited way to stop them; once someone asks, new messages are prohibited. Whether WhatsApp counts as a telephone messaging service is an interpretation.[3]

  7. Point 7

    WhatsApp's own opt-in rule

Meta's WhatsApp Business Messaging Policy requires the person's opt-in confirming they want messages from you, under either Chilean law.[16]
